Copyright and takedown
How to tell us about content that infringes your copyright, and how we handle notices and counter-notices.
In short
- Files are private
We don't publish what people upload; files belong to their owner.
- One complete notice
Six details, sent by email, and we act on it.
- Fair to both sides
Account holders can send a counter-notice.
1We respect copyright
ToolsMotive processes files for the people who upload them; files are private to their owner and are not published by us. If you believe content stored or processed through the service, or content on our own pages, infringes your copyright, tell us and we will act on valid notices.
2How to send a takedown notice
Email our contact form with the subject "Copyright notice" and include:
- Your name, address, phone number and email.
- A description of the copyrighted work you believe is infringed.
- Where the material is (a web address, or enough detail for us to find it).
- A statement that you believe in good faith the use is not authorised by the owner, its agent or the law.
- A statement that the information is accurate and, under penalty of perjury, that you are the owner or authorised to act for them.
- Your physical or electronic signature.
Knowingly false notices can make the sender liable for damages. If you are not sure, get legal advice first.
3What we do
We review each complete notice, remove or disable access to the material where appropriate, and tell the account holder, including a copy of the notice where the law allows. We close the accounts of repeat infringers.
4Counter-notice
If your content was removed and you believe it was a mistake or you have permission, you can send a counter-notice with: your contact details; what was removed and where it was; a statement under penalty of perjury that you believe it was removed by mistake or misidentification; your consent to the jurisdiction of the relevant courts; and your signature. We may restore the content unless the complainant tells us they have started legal action.
5Trademarks and other rights
For trademark, privacy or other complaints, write to the same address and explain the right concerned and where the content is. We handle these under our acceptable use policy and the law.
